Appeals

You have the right to appeal any capability warning or dismissal. This should be done in writing to a director within 7 days of the decision. Your appeal will be heard by a director and the process followed will be the same as for a Disciplinary Appeal Hearing.  Decisions made on appeal shall be final.

Full consideration should be given as to the reason for appeal and, in general, appeals may be raised by you on the following grounds:

  • The original hearing was in some way procedurally unfair and/or
  • The type of warning imposed in the original hearing was excessive in relation to the nature of the capability issue and/or
  • New evidence of a material nature, which could not reasonably have been known at the time, came to light immediately after the original hearing.
