Confidentiality
Unless otherwise agreed by the two parties, both the fact that mediation is taking place, and the contents of any discussions, are to be kept confidential to the parties involved and the mediator. The exception to this would be if a party raised issues of harm to self or others, or issues of serious misconduct.
A record of the mediation process is not to be kept on personnel files. Any notes taken by the mediator or the two parties are to be destroyed once the mediation has been concluded.
A written agreement made during mediation will be kept only by the parties involved and not shared with others unless agreed by both parties. If the mediator keeps a copy, for instance, for evaluation or for the purposes of continuous development, this will be anonymised.
Limited records will be kept for the purpose of ongoing monitoring.
