  • If 28 weeks’ worth of SSP have already been taken and the new period of sickness links to the previous period.
  • If your average weekly earnings are less than the Lower Earnings Limit for National Insurance contributions.
  • If you have received Employment Support Allowance (ESA) within 12 weeks of becoming sick or returning to work. 
  • If no work has been completed under your contract. 
  • If you are in custody or on strike on the first day of sickness (including any linked periods).
  • If you are off work for a pregnancy-related illness in the 4 weeks before the week that your baby is due.
  • If you are receiving Statutory Maternity Pay or Maternity Allowance.
  • If you are absent from work for compassionate reasons but are not personally incapable of work.
  • If you are working outside the EU and you are not liable for their National Insurance contributions.
